These Terms of Sale apply to purchases made from the CosmeticShelf online store at cosmeticshelf.com.

1. Products and Prices
Products available for purchase from the CosmeticShelf online store are presented in the website catalogue.
The assortment includes, among other products, home-care products from professional cosmetic lines.
The product page provides the main characteristics, intended use and other necessary information about each product.
All prices are stated in euros and include VAT.
Delivery costs are not included in the product price and are shown separately during checkout.
The Seller may change prices and the product assortment. A price change does not affect an order that has already been placed.
The manufacturer may change the appearance of the packaging without changing the product itself. Such a change alone does not constitute a defect in the product.
2. Placing an Order
To place an order, the Buyer selects the required products, adds them to the shopping cart and proceeds to checkout.
During checkout, the Buyer can see the selected products, their quantity and price and can correct any errors before completing the order.
The Buyer provides contact details and the information required for delivery.
After the order has been placed, an order confirmation is sent to the e-mail address provided by the Buyer.
3. Payment
Available payment methods are shown during checkout.
Before making payment, the Buyer can see the total amount of the order, including the cost of the products and delivery.
Payment is made using one of the payment methods available in the online store at the time the order is placed.
When paying by bank card, the payment is processed in the secure environment of the payment service provider. CosmeticShelf does not receive the Buyer’s bank card details.
CosmeticShelf does not charge any additional fees beyond the amount shown during checkout.
4. Delivery
Paid orders are dispatched within 1–3 business days.
Orders to Estonia, Latvia, Lithuania and Finland are delivered to SmartPosti parcel terminals and pickup points.
Orders to other countries are delivered by postal or courier services selected by the Seller depending on the destination country.
Delivery costs are shown during checkout.
The delivery time after dispatch depends on the destination country and the delivery service used.
The Buyer must provide correct information required for receiving the order.
If the Buyer does not collect the parcel from a pickup point or parcel terminal within the specified period, or does not receive the parcel from the courier, and the parcel is returned to the Seller, the Buyer must pay the return delivery costs in the actual amount charged by the delivery service.
The Seller will contact the Buyer to agree on further action regarding the order.
Damage During Delivery
If visible damage to the outer packaging is noticed when the parcel is received, the Buyer should photograph the condition of the parcel before opening it.
If damage to the product that may have occurred during delivery is discovered after opening the parcel, the Buyer must inform the Seller as soon as possible and provide photographs.
The photographs must show:
- the outer packaging of the parcel;
- the internal packaging;
- the damaged product;
- where possible, an overall view of the opened parcel showing the position of the products inside.
The damaged product and packaging must be kept until the claim has been fully reviewed.
These materials are necessary to establish the circumstances of the damage and to allow the Seller to submit a claim to the delivery service.
If the Buyer does not provide photographs or other materials that make it possible to establish the condition of the parcel, packaging and product at the time of receipt, the Seller will review the claim on the basis of the available evidence. The absence of the necessary evidence may make it impossible to confirm that the damage occurred during delivery.
5. 14-Day Right of Withdrawal
A Buyer who purchases goods as a private individual for personal use has the right to withdraw from the purchase within 14 calendar days after receiving the product, without giving any reason.
To exercise the right of withdrawal, the Buyer must inform the Seller before the end of the 14-day withdrawal period.

The Buyer may also use the withdrawal form provided at the end of these Terms.
Use of this specific form is not mandatory. It is sufficient to clearly inform the Seller of the decision to withdraw from the purchase.
After giving notice of withdrawal, the Buyer must return the product to the Seller without undue delay, and in any event no later than 14 days from the date on which the Buyer informed the Seller of the withdrawal.

The Buyer bears the cost of returning the product in the case of an ordinary 14-day withdrawal.
6. Condition of Returned Products
The Buyer may examine the product only to the extent necessary to establish its nature, characteristics and functioning.
If the value of the product has decreased as a result of the Buyer’s actions, the Seller may reduce the amount refunded by the amount of the decrease in value.
7. When the 14-Day Right of Withdrawal Does Not Apply
The 14-day right of withdrawal does not apply to cosmetic products and other sealed goods which are not suitable for return for health protection or hygiene reasons once the packaging has been opened.
8. Refunds
A refund is made where the Buyer has a right of withdrawal in accordance with applicable law and these Terms of Sale.
After receiving the notice of withdrawal, the Seller refunds the payments due to be refunded without undue delay and no later than 14 days.
The Seller may withhold the refund until the returned product has been received or until the Buyer provides evidence that the returned product has been sent back, whichever occurs first.
Upon withdrawal from the purchase, the Seller refunds all payments that must be refunded to the Buyer in accordance with applicable law.
The refund is made using the same payment method used for the original transaction unless another method has been agreed with the Buyer.
The Buyer bears the cost of returning the product. If the cost of returning the product exceeds the cost of the original delivery of the order, the Seller does not reimburse the difference.
9. Defective Products or Products Not Conforming to the Order
If a product is defective, the Buyer has received a different product from the one ordered, or something is missing from the order, the Buyer may contact the Seller at:
The Buyer may exercise the rights provided by law in relation to a defective product for two years after receiving the product.
This two-year period does not extend the expiry date or period of use specified by the manufacturer.
If a defect becomes apparent within the first year after receiving the product, it is presumed to have existed at the time the product was delivered, unless the nature of the product or the defect indicates otherwise.
The Buyer must inform the Seller of the defect within two months after discovering it.
The Buyer has the remedies provided by law in the event that the product does not conform to the contract.
The Seller is not responsible for defects or damage arising after delivery due to incorrect use or storage, failure to follow instructions, or use after the expiry date or after the specified period of use following opening.
An individual reaction to a cosmetic product does not in itself constitute a defect in the product.

The complaint should include information sufficient to identify the purchase and the nature of the claim.
The Seller may request proof of purchase.
The Seller responds to a written complaint within 15 days of receiving it.
If the matter cannot be resolved within this period, the Seller will inform the Buyer of the reason for the delay and provide a new reasonable deadline for the response.
If the claim is rejected in whole or in part, the Seller will provide the reason for the rejection.
11. Purchases for Professional or Business Purposes
The 14-day right of withdrawal and other specific consumer rights apply to natural persons who purchase products primarily for personal purposes.
If a product is purchased for business or professional purposes, including for use in a beauty salon, cosmetology practice, clinic or for resale, specific consumer rights, including the 14-day right of withdrawal without giving a reason, do not apply.
The return of a non-defective product purchased for business or professional purposes is possible only by prior agreement with the Seller.
12. Dispute Resolution

If the Buyer is a consumer and the dispute cannot be resolved directly with the Seller, the Buyer may contact the Consumer Disputes Committee (Tarbijavaidluste komisjon) of the Estonian Consumer Protection and Technical Regulatory Authority (TTJA).
In the case of a cross-border dispute within the European Union, the Buyer may also contact the European Consumer Centre.
Applying to the Consumer Disputes Committee does not restrict the Buyer’s right to bring the matter before a court.
The contract is governed by the laws of the Republic of Estonia. If the consumer permanently resides in another European Union country, the application of Estonian law does not deprive the consumer of the mandatory consumer protection granted by the applicable laws of the consumer’s country of residence.

This form may be used to withdraw from a purchase within the applicable 14-day withdrawal period.
